CLAIM FOR DAMAGES.

Dcbinc the last three days the Sur>rem# " Court has been engaged hearing a claim for £501 damages for alleged malicious pro* ■;: i secation brought by Robert Aiken against i .James H. Plarcourt, land and estate agent.. The circumstances were that in March lasts plaintiff, who was a salesman in defendant's employ, was arrested on a warrant charged with the embezzlement of £3 4s lid. The charge was dismissed by the' SIM. The plaintiff then instituted these '* proceedings. It appeared that Aiken had; control of the cash-box in HarcourtV office, and of this cash-box Harcourt'a -son had a duplicate key. It was shown to have been the custom of Aiken to borrow; money from petty cash as advances against salary and commissions, giving 1.0.U.'s for the amounts so borrowed, and it was ' out of an alleged discrepancy in cash and these 1.0.U.'s that the proceedings were first taken. The present case concluded to-night, when the jury returned & ver* diet for Aiken for £350 damages. . - , ~
