MAGISTRATE'S COURT.-Thursday. [Before Mr. H. W. Nortlicroft, S.M.] 1 Undefended Cases.— the following undefended cases judgment was Riven for the plaintiffs, with costs : —Moritzson and Gilmour v. R. W. Brown, claim £5 18s, and costs £1 19s 6d; Nelson, Moate, and Cd. v. Alex. J. Maokie, claim £12 2s Bd, and costs £2 8s 6d: Robert B. Young v. Edward Newman Legge and Andrew Legge, claim £169 7s sd, and costs £8 7a ; George if oster v. Timothy Tiusley, claim £6 8s 9<l, and costs £1 lis 6(1; James Rae v. William Baker, claim £7 14s, and cost 12s. P. and G. Foster v. Henry Carter, claim £3 9s Id, and costs 12s; Otahulm Trotting Club v. T. Elleinau, claim £32 17s, and costs £3 13s; Wm. C. Griffiths v. Elizabeth Otway, claim £6 Is 7d, and costs 10s. James Rae v. H. Williamson.—This was a claim for possession of tenement of a house occupied by the defendant. Mr. Brassey appeared for the defendant, and the plaintiff in person. His Worship made an order for possession of tenement to be given on or before the 16th of August, 1894. MERCER S.M. COURT. [Before Captain Jackson, S.M.I Wednesday, August 1. Charge of Cattle-stealing Dismissed.— The charge of alleged cattle stealing preferred against Messrs. Vickers, Otto, and Allcock, occupied the Court all day, and great interest was manifested in the proceedings, the Court being crowded, It will be remembered that the accused were arrested at Hamilton by Constables Hobson and Forbes, and brought up at the Hamilton Police Court and ■ reminded to Mercer. I Constable Hobson conducted the prosecution, and Mr. T. Cotter appeared for the accused, who pleaded not gudty. The facts of the case are briefly as follows :—The defendants were driving a mob of about 40 head of cattle from Remuera to the Waikato, and in passing through Bombay four head of cattle, belonging to Mr Conolly, through some means, strayed into the mob, and the mistake was not noticed until their arrival at Pokeno, where the drovers drafted out three of the cattle and continued on their journey with one of Mr. Conolly's cattle included. It appears that they had lost one of their number on the way unknown to the drovers, and Mr. Conolly's cow resembled the one dropped on the road. On their arrival at Hamilton they were charged by the constables with cattle , stealing. Evidence for the prosecution was given by Constable Forbes, Messrs. Hay ward, J. Stewart, S. Hamlin, Morris, and W. Thomson. For the defence, by Messrs. Vickers, McDonald, and J. Dean. After hearing the evidence, Captain Jackson decided to dismiss the case, being of opinion that there was no intention of stealing the cattle. The accused are well-known and highly respected in the Waikato.— [Pokeno Co-respondent.]
