Stealing a Chbe3e. —Cornelius Gleesont John Morgan, and Patrick Carrol, were charged with stealing a cheese, worth 10s, the property of Frank Pelley, from the cabin of the cutter Rose, at Auckland. Prisoners pleaded not guilty. Frank Pelly deposed that he was the master of the cutter Rose. He went ashore on Tuesday night, and when he went aboard again, he saw the prisoner in the cabin eating bread and cheeee. The cheese was part of the cargo. The prisoners had no bueiness on board the cutler. Wai. ter Eggerton deposed that he was in charge of the cutter. The captain was on shore. The prisoners came on board the cntter, and would not go off. He then went ashore and told the captain. When he came back to the cutter the prisoners had cut the cheese and were in the act of eating it. John Lndlow deposed that he saw the prisoners in the cabin of the Rose. He heard the last witness order them ashore, but could not eee what they were doing in the cabin. Constable Alexander deposed that he arrested the prisoners on the charge. The Bench thought there was no evidence to shew that Morgan and Carrol touched the cheese, although some of it was before them. They could oaly be charged under the Vagrant Act, by being found by night without lawful excuse on board the cutter Rose. Prisoners said they were allowed to go on board by Mr. Holdship. The charge of stealing against John Morgan and Patrick Carrol was dismissed, and they were then charged with being found by night without lawful excuse, on board the cutter Rose. Prisoners pleaded not guilty. Walter Eggerton deposed that he was a seaman on board the Rose. The prisoners came on board, and when told to leave used obscene language and refusedFrank felly deposed that he was the master of the Rose. When he went on board he found the prisoners in the cabin. They refused to leave. Prisoners were then sentenced to seven days' imprisonment with hard labour. Gleeson was sentenced to 24 hours , imprisonment with hard labour for stealing the cheese.
