WRIT OF MANDAMUS
APPLICATION BY POSTAL OFFICIAL (United Press Association) • WELLINGTON, This Day Before Mr Justice MacGregor m the Supreme Court is proceeding an up plication for the issue of a writ o man damns against the Post and lelegiap i Board of Appeal by James Alexander Elliott, postal official, who pleads that ho had been fined £lO for accepting a post-dated cheque for £3O in October, 1925, one of a. series of valueless cheques by which William Smith and fycjiey Eric Baivmo fraudulently secured Bill- - which £1026 was recovered. Elliott pleads that lie followed the departmental regulations arid should not have to pay a fine. The Appeal Hoard had ie* fused to proceed wit b. the heaving. The department sets out several grounds why the application should fail, among which is one that the Liu was not a fine hut Elliott s share of the missing amount of £B4, which had to be made good by the officials concerned. The judge dismissed Elliott s application for a writ of mandamus.
