CONTRACT FOR SALE
ACTION FOR ENFORCEMENT

WELLINGTON, This Day. An action for enforcement of a contract relating to the sale of the Trocadero Hotel on Lamb ton Quay for £40,000 came, before Mr Justice. Alpers at the Supreme Court to-day. Plaintiffs were the Public Trustee, sole executor under the will of Hamilton Gilmer and executor trustee under the will of Allen Maguire, Sir Charles Skerrett, Chief Justice, .Mary Ann McArdle, and John O'Kane, executors and trustees under the will of Owen McArdle. Defendant was Robert Duncan Benjamin, builder, Christchurch. Plaintiffs claimed the defendant contracted to buy the property. They had applied to the defendant to perform the agreement. They were still ready t« perform their part. Because of defendant's failure to- perform they had been caused serious loss and expense. They asked the. court for an order for specific performance, otherwise, £ISOO damages and £750 special damages. The defence is false representation in regard to the property.
