i DUNEDIN, Friday. j Mr "Widdowson, S.M., gave judgment this morning in the case of the Acclhnat- | isation Society v. Samuel R. Gardham, in which the defendant was charged ivith se|ling trout on February Ist con-
trary to the provisions of the Fisheries' Conservation Act, 1884, and the regulations made under it. The facts of the case were proved, but defendant contended that the information must be dismissed on three grounds, the principal of which was that the regulation made under subsection (whicli it was claimed had restricted power) were too wide, being absolute prohibition, and therefore ultra vires. The Magistrate held otherwise, and convicted the defendant, fining him £5 and costs (£2).
