Appeal By Howe's Owner
WELLINGTON, Sat. (P.A.)—The appeal of Mr J. H. Marshall, owner of Howe, to the Racing Conference against the decision of the Auckland District Committee, which confirmed action taken by the Auckland Racing Club’s judicial committee in altering the placings in the 1947 Auckland Cup and awarding the race to Balgowan, was opened in Wellington yesterday.
After a lengthy sitting the hearing was adjourned. Mr H. V. Lunken, owner of King’s Ransom, which was placed second, has also appealed, and this is being heard in conjunction with Mr Marshall’s appeal. The judges are Messrs J. Macfarlane Laing (Masterton), J. Graham Field, and P. A. O’Neill (Wanganui). Dr O. C. Mazengarb, K.C., is appearing for Mr Marshall, Mr W. E. Leicester for Mr Lunken, and Mr V. R. Meredith for the Auckland District Committee.
Howe finished first in the Auckland Cup at Ellerslie on December 26, but was placed third after an inquiry on the ground of alleged interference. An appeal . by Mr J. H. Marshall, owner of Howe, to the Auckland District Committee, was dismissed on February 3, and the appellant’s deposit of £5 was ordered to be forfeited.
On February 16 Mr Marshall lodged an appeal to the New Zealand Racing Conference against the decision of the Auckland District Committee.
