NEPHEW UPSETS UNCLE'S WILL

£100,000 INVOLVED.

MELBOURNE, Sept. 2.

Mr C. L. Forrest ,ex-member of Parliament, died a year ago, leaving an estate valued at £103,137 whereof over £80,000 was bequeathed to create a Trust for charitable and philanthropic purposes. Mr Charles Forrest, nephew of the deceased, as the only next of kin sought the court's ruling as to whether the Trust is void on the ground of uncertainty in the terms of the -bequest.

The Chief Justice, in delivering the court's judgment yesterday, declared that Forrest died intestate, and the whole Trust was void for its uncertainty.

The whole of the money therefore goes to the nephew upon clearly establishing that he is the sole 1 next of kin.
