The judgment, dealing with a change of gear made with the horse, states: “In view of the fact that, after the purported permission was given by a member of the judicial committee, the chief stipendiary steward told the owner that permission had not been granted, we think the owner should have taken further steps to ascertain the true position, and that lie failed to do so. We therefore fine him £25.” The case has been the subject of several appeals, and on the subject the j udgment reads: “To a great extent the trouble was created bv the action of the club, whose handling of the situation, both before and after the race, left much to be desired. The result has been a succession of hearings culminating in this present appeal, and we think the club should tear some of the cost that the Conference and appellant have been put to. We therefore adjudge that the Metropolitan Trotting Club pay the sum of ’ £lO towards the expenses of the Conference and the sum of £l3O towards the costs and expenses of appellant in connection with this appeal.
