BRADY SENT FOR TRIAL. INQUIRY CONCLUDES. SYDNEY, July 16. The inquiry before a Magistrate into the supposed death of James Smith was concluded to-day. Patrick Brady, who is charged with the murder of Smith, was committed for trial. Cross-examined by Mr Evatt, Detec-tive-Sergeant Allmond said be had not been engaged on the Pathfinder inquiries. Sergeant Toole’s objection to further questioning along these lines was allowed by tifa Magistrate, Mr MacDougal. Further cross-examined by Air Evatt, Detective-Sergeant Allmond said that the first statement which was made by Holmes on Alay 17 did not allege that Brady murdered Smith. When Holmes was taken aboard the police launch after the harbour incident on May 2U lie was intoxicated, and had a bullet wound in liis head. Air Evatt: Have you any idea how the wound was inflicted? Detective-Sergeant Allmond: I have, but I may be totally wrong. It is my opinion that he attempted to take liis own life. There was no weapon in the launch. Witness denied that Holmes made a signed statement at any time between those made on Alay 17 and Alay 28. He also denied that when Airs Brady was being questioned at the C. 1.8. be bad said to her: “Hohnes did not shoot himself for nothing. Try to induce Pat to tell us everything. In our opinion Holmes murdered Smith, but Pat knows all about it. It all arises but of the sinking of the Pathfinder.” This concluded tho evidence. Brady was committeed for trial on the charge of having murdered Smith. Bail was granted in three sureties totalling £3OOO. Brady, in a statement from the body of tlie Court, said that Smith had been one of his best friends, and when he last saw Smith the latter was fit and well. They had parted the best of friends with the understanding - that they would meet the next day. “Aly conscience is clear as to his death if lie is dead. On my counsel’s advice I reserve my defence.” The trial was fixed for August 26.
