MAGISTRATE’S COURT.
CLAIM FOII £75. Tho Fcilding Magistrate’s Court was occupied ail day on Tuesday in hearing a claim for £75 lodged by S. Sherrard, of Maewa, Feildmg, against L. Beazer, of Fcilding. in respect of two horses killed by the Limited express on the night of May 10 last. It was alleged that the cause of the mishap was defendant having left open gates of plaintiff’s property at a private crossing. Mr It. M. 'Watson, S.M., was on tho Bench, Mr D. C. Cullinane appeared for plaintiff, and Mr H. It. Cooper for defendant. The case was before the Court on September 27, 1934, when plaintiff was non-suited and the fresh action was instituted on Tuesday, when additional evidence was called. At the conclusion of the lengthy hearing the .Magistrate intimated that he would reserve his decision and decide the question of fact as to whether tlie crates being left open or not had caused tho death of the horses. If he found in favour of the plaintiff in this respdict, the Magistrate said he would hear legal argument by counsel; but , if his finding was against plaintiff on the above point that would be the end of the case and the decision would have i to be for defendant.
