CLAIM FOR DAMAGES.
FULL AMOUNT AWARDED. The hearing was concluded in the Magistrate’s Court, this afternoon, before Mr J. L. .Stout, S.M., of the case in which William White, storekeeper, of Palmerston North (Mr JA. Grant) claimed £27 13s 6d damages from Hector A. B. Coleman, of Maxton (Mr T. F. Rolling) as the outcome of a collision on February 26, at the intersection of Rangitikei and Featberston Streets, between defendant’s car and plaintiff’s motor vehicle, which was driven by Mrs Julia Morgan. Ellen Ma-rv Guthrie, of Marton, a frassenger in defendant’s car, and Lilian Sarah McDonald, another passenger, gave corroborative evidence for the defence when the case was resumed. Frank Senter, garage service manager, testified that he recently examined plaintiff’s car and estimated the cost of repairing it at £2l. In his opinion it was not worth repairing. “I think that the only thing which I have to consider in this case is tire question of damages,” commented the Magistrate. “There is no doubt that defendant not only did not give way to traffic approaching from the right but also had the last opportunity of avoiding an accident.” The Magistrate gave judgment for plaintiff for. the full amount claimed, together, with £2 6s Court costs, £2 witnesses’ expenses and £4 3s for solicitor’s fee.
