BREACHES OF AWARD.

CONTRACTOR FINED. A case was heard at the Magistrate’s Court this morning, before Mr J. L. Stout, S.M., wherein the inspector ot awards, Mr J. Lowdcn, •sought to recover from J. Wischnewsky, contractor, the sum of £2O as a penalty for two breaches of the ' Northern Taranaki, Wellington, Nelson, Canterbury, Otago and Southland Carpenters’ and Joiners’ Award, in that defendant had employed two men, L. Wilcox and It. Shand, as carpenters and had failed to pay them overtime rates for certain hours worked. Defendant also had to answer a charge that he had failed to keep a proper wages and overtime book. Defendant, through his solicitor, Mr Oakley, admitted the breaches. Defendant, said Mr Lowden, had employed the two men mentioned on Saturday afternoons in order to get certain work through as expeditiously as possible, and had failed to pay overtime rates for those particular hours. The case was brought to call attention to the fact that Saturday afternoon worl: was overtime and had to be paid for as such. Counsel said that his client had acted in ignorance of the award, thinking that, if there had been a broken week, he could employ the men on Saturday afternoons without paying overtime rates, provided that the to-

tal hours of work did not exceed 44. The Magistrate ordered defendant to pay £5 on eacli of the two claims and imposed a fine of £5 on the charge of failure to keep a proper record.
