OVER A RACECOURSE. (Peb Press Association , .) WELLINGTON, April 6. The Appoal Court is occupied to-day with the case affecting the powers of the Wangamii Jockey Club over their racecourse. They summoned' certain defendants for trespassing and the defence 6ct up was that right of way was acquired over the course by its use for a period of more than 20 years. Judge Edwards non-suited plaintiffs on the ground that they only held a lease from the trustees of the reserve used ae a racecourse, and therefore possession of the reserve was not in them exclusively, and they could not maintain an action for trespass.

From this judgment plaintiffs appealed. Messrs Skcrrert and Hutton appear for appellants and Messrs Hutchison and Mackay for respondents.
