THE ACCUSED'S EVIDENCE.

GORE, Aug. 17. The court-martial of Sergeant-Majoi Sutton, of the permanent staff charged with conduct prejudicial ix good order and military discipline ir that, on July 30, on being ordered bj Captain Glendining to proceed to Balfour as his headquarters from Augusi 1, he replied: "I refuse to do so," or words to that effect, was continued last evening. Sutton gave evidence to the effect that Quartermaster-Sergt. Graham in- ' formed him on alighting from the train at Gore that he was to proceed to Balfour for the purpose of selecting a house, and get two tenders for the removal of his effects. The witness left the same day for Balfour. He returned next morning, reporting his inability to get a house, as none was available. He was ordered to get tenders for the removal of his furniture despite his inability to get a house. The witness laid the facts of his mission before Captain. Glendining, and expressed the opinion that the Department would have to make other arrangements. This was on July 29th. Captain Glendining asked the witness point-blank whether he would go to Balfour or not. The, witness asked Captain Glendining's permission to see the group, officer for the purpose of complaining of Captain Glendining's bearing towards him, but he refused. He replied to Captain Glendining: "No, sir, I do not refuse duty, because 1 cannot go to Balfour; there are no -quarters there." Captain Glendining said: "You can go home, and consider yourself under open arrest."

Mr Oochrarie, for the accused, addressed the Court, which, adjourned to deliberate. On resuming the Court -adjourned further proceedings in order to consult Colonel Bauchop, the officer commanding the district.
