AN ACCIDENT INSURANCE CASE.
[Per Press Association.] NAPIER, July 9. A case of considerable importance, affecting accident insurance, • came before, the Magistrate this morning. Dr Delisle sued the New Zealand Accident Insurance Company for £l3 (?) under one; of the company's policies, as compensation for twelve weeks' total and fourteen weeks' partial disablement through an accident. For the defence it was argued that under the conditions of the policy, action should have been brought within six months after the date of the accident. The plaintiffs counsel argued that the clause was ultra vires, because a person might be so seriously injured as not to be able to estimate his claim within six months, and, further, that the company had waived its right by continuing its "negotiations after six months had expired. Judgment was reserved.
