CREAM STANDS

POSITION ON ROADS REPLY FROM MINISTER LIABILITY WITH ERECTION A reply to a letter from the Northern Thames Sub-Provincial Executive of the Farmers’ Union to the Minister of Agriculture, the Hon. B. Roberts, asking that cream stands should be placed in the same category as power and telephone poles for risk liabilities, was received at the annual meeting of the Northern Thames Farmers’ Union.

Any person may construct a building or other structure on the road with the consent of the local authorities, said Mr Roberts. However, the statutory right of erection conferred on the Crown and electric power board's does not absolve them from liability for damage, if the power or telephone pole is< so positioned on the land likely to result in an accident to a person lawfully entitled to use the highway. The statutory right of erection, continued the letter, is limited to the responsible authorities who may be expected to take all reasonable precautions to ensure such structures are erected so that a person using the highway is not obstructed or endangered. The local authority may stipulate the in which the structure is to be erected so as not to cause obstruction or danger. The letter was received. CONSIDERED DANGEROUS MARATOTO ROAD CORNER The county engineer, Mr L. E. Shaw, informed the Ohinemuri County Council at its April meeting that he was endeavouring to contact a representative of the owners of a cream stand at the corner of the Maratoto road and the Paeroa Main Highway. The stand, he said, was in a dangerous position for traffic and an alteration was necessary.
