WIDOW’S APPLICATION FAILS
VARIATION OF WILL SOUGHT. At the last sitting of the New Plymouth Supreme Court application was made by Amelia Geary, widow of George William Geary, late of Manul#ihi, farmer, for an order that adequate provision for her proper maintenance and support be made out of the estate of her husband. The grounds were that since the expiry of 12 months from the date of probate of the will, it had come to her knowledge that the estate had become unexpectedly materially augumented by the sale of the farm in which her latei husband was interested at a 'price exceeding the valuation made for the purposes of death duties. His Honour (Sir Michael Myers) has now given judgment (previously reserved) dismissing the application, holding that there were not sufficient grounds to justify any variation of the will. 1 At the hearing Mr. P. P. Anderson appeared for plaintiff and Mr. A. K. North represented the trustees and residuary legatees.
