JUDGMENTS BY DEFAULT
Judgment for plaintiff by default in the following civil cases was given by Alessrs E. F. Hemingway and J. A. Ha-swell, J’s.P., in the Patea Aiagistrate's Court yesterday: Patea Harbour Board v. B. F. C. Savage, £3 Gs 4d (costs £1 5s Gd); P. E. Rossiter v. P. Locker, £2 (8s); R. A. Adams and Sons, Ltd. v. Arthur Elliott, £2 4s (£1 3s Gd); same v. Kai Kahui. £5 lbs Gd (£1 19s Gd); A. Edser v. L. T. Poingdestre. £3 Gs (Cl 5s Gd).
INSPECTOR’S CHARGE DISMISSED
On ihe information of the traffic inspector (Mr E. Wilson), AV. O'. Glenny was charged with having carried a greater load on his motor lorry than it i;s licensed to carry in the Patea C'ountv.
The inspector said that lie had weighed defendant’s lorry at Kakaraliioat on August 11, the weight being 3 tons 19cwt. Defendant’s lorry was registered in Class C, which entitled him to carry a maximum load of from 3 to 3*cut.
To Mr Rutherford, who appeared for defendant and pleaded not guilty, the inspector stated that two days after the alleged offence defendant’s load was tested and weighed 281 b light. Defendant stated that the total weight of the lorry, including the driver and load, was about- ,S tons 9ewt. He Iliad had the weight of the lorry and its driver given him by Mr Fear, chief traffic inspector. Similar evidence was given by F. C. Fitzwater, driver of the lorry. In view of the fact that the loadmeter was -fewt out they would give defendant the benefit of the doubt, .said the Bench. The ease was dismissed. solicitor’s fee, Ids Ocl, being allowed.
