SYDNEY, Aug. 31. Emile Polini, the well-known actress, whose death occurred in America some time ago, left a will which came before the New South Wales courts for interpretation The. testatrix excluded the widower, who is an Australian, from the will, and left all her money to her four-year-old daughter Patricia,, on condition that she was taken from her father and reared by an uncle and aunt in England, but should the father decline to agree to this arrangement then the child’s inheritance should he substantially reduced. The court held that tlie testatrix’s condition was opposed to public policy, and was likely to deter the father from performing his parental duty, which was sacred and just, as were his rights. Therefore the gift to Patricia was absolute under this' condition. Tlie child will inherit the whole estate when 24 years old. totalling about £20,000.
