Application was made to tlie New South Wales Full Court to-day for an order nisi for a writ of attachment alleging contempt of court against the proprietors of the “Sydney Morning Herald” and the publisher, Herbert Dads well, on behalf of Jock Garden, Kavanagh, M. P. Ryan and other members of the Trades Hall disputes committee, who are awaiting prosecution on a charge of conspiracy in connection with the timber workers’ strike. Counsel for applicants submitted that the. “Herald” editorials of July 29 and August 7 contained comments unfair and injurious, inferring that Garden and others arrested were responsible for the acts of the “basher gangs” and their trials in consequence were likely tp. be prejudiced.
