Mr Justice Branson, King’s Bench division, is taking evidence in an importat test action upon winch other claims depend, relating to brown heart in apples. Bradley and Sons, Ltd., of Covent Garden, are claiming £4314 from the Federal Steam Navigation Company, owners of the Northumberland, owing to development of brown heart in apples shipped on the Northumberland from Hobart in April, 1921.

The main issue of the case is the plaintiffs’ allegation that brown heart was due to bad ventilation in the Northumberland’s hold. The defence is that the brown heart was due to inherent defects in the apples when shipped. The defendants alternatively pleaded that the apple cases were insufficiently ventilated, and is also relying on the exceptions set out in the bills of lading relating to the perils of the sea as giving the owners immunity from responsibility in the event of reasonable means having been taken to provide against a ship’s defects and unseaworthiness.—A. and N.Z.
