BAPTIST CHURCH LOSES SUIT
P.A. AUCKLAND, October 11. In the Bapilst Tabernacle lawsuit Mr Justice Finlay non-suited the Tabernacle as against the Tabernacle Youth Camp Incorporated and 18 of its memebrs in the action begun yesterday to determine the beneficial owner of the Mountain Home and nine acres of land in the Waitakere Ranges.
The Judge refused a request by Counsel for the defendent society for nominal damages on an interim injunction granted to the Churcr, restraining the defendants from using the property. His Honour said that there was confusion on both sides as between the ethical and the legal. There was no doubt that, in the initial stages the property was acquired for general church purposes. He thought that there was never any trust since the Youth Organisation was created.
