£lOOO Claim RAILWAY PASSENGER’S FALL (Per Press Association.) WELLINGTON, August 22. At the Supreme Court Helen Henrietta Priestly, a widow, claimed £IOOC from the Crown for injuries received in alighting from a train. She alleged that the guard promised to assist hci when the train arrived at the National Park, but he failed to keep hi- pro fcinise. She alighted without assistance and fell, sustaining injuries, froi* which she is still suffering. The defence admitted that the guarf made the promise, but alleged that when the guard went to assist th* claimant, she had already alighted. Counsel applied for a non-suit on th, ground that the promise was givei gratuitously, and entailed no duty o ’ the guard to keep it
