A HOUSING CASE.

APPLICATION FOR POSSESSION

A claim for the possession of a house in Lvtton Road was heard by Mr J. S. Barton, S.M., at the Magistrate’s Court yesterday morning, the plaintiff being Thomas Leslie (Air Nolan) as trustee of the Wm. AlcKinley estate, and the defendant Russel Bilharn (Air R. B. Hill).

The house, it was stated, was part of the estate of the late William Mckinley, and its possession was now desired for the deceased’s widow, in order that she could live rent free. For the plaintiff it was stated that other houses ’ had been offered to the defendant when he was given notice to quit. Airs McKinley was now paying more rent than was being received from the house occupied by defendant.

For the defence Air Hill said that the question was one of relative .hardship. The defendant had three children and had been unable to get another house. Defendant was driving a baker’s cart, and consequently was in a good position to obtain another house wore one available.

After hearing the evidence the Alagistra.te said he did not think .there was sufficient evidence to warrant his making an order, and the application would therefore be refused.
