INFRINGEMENT OF COURT’S POWERS
(P a ) WHANGAREI, April 7. “I consider it is for the court to say whether or not a penaly should be imposed if e breach has been committed. I think it is quite wrong to admit any system where it is in.the hands of any individual outside the court to say if an offender should be punished. This is against the principle of British justice.” , , These comments were made by Mr. Harley, S.M., in the Kaitai Magistrate s Court when hearing charges of overloading vehicles preferred against pri'vately owned transport companies and followed a statement by a Transport Department inspector that New Zealand Road Services vehicles were, allegedly found to be overloaded on the same occasion. Transport offence notices had been served on New Zealand Road Services drivers and the alleged breaches reported to the Transport Department.
