JURY DISAGREEMENTS.

AUCKLAND, August 12.

A fourth trial was ordered’ by Mr Justice Smith, when the jury failed to agree in the case in which Narwood Dean Farmer aged 38, was charged on five counts of carnal knowledge. Accused was first tried before Justice Smith in May, when the jury failed to agree, and a second trial was held before Justice Herdman. The jury returned a verdict of guilty, but the Jud’ge reserved the questions of law as to misdirection. The Appeal Court quashed the conviction. * At the third trial, the jury returned with an announcement that there was no possible hope of agreement. Counsel for the Crown thereupon moved for a new trial. In opposing, counsel for the defence said: It seems to me there is a process of financial exhaustion to bring my client to a new trial. Everything has been done in the interests of justice and of society. His Honor said: As the Crown has asked for a new trial, the course is to discharge the jury and order a new trial and leave it to the SolicitorGeneral whether he grants a nolle prosequi or not.
