ENEMY PROPERTY

SEQUEL TO WAR-TIME SALE,

(Per Press Association.)

. . WELLINGTON, August 27. - A sequel to the action taken by the Public Trustee, under the War Regulations in regard to enemy property, came before the Supreme Court to-day. During the war the Public Trustee took possession of the New Zealand assets of the German firm of Hardt and Co. This firm had a branch in Sydney, which was managed by Eugene Schroder, and which-, controlled theNew Zealand branch. The Public Trustee had in hand £17,000. Hardt purported to sell to Schroder the whole of the Australian and New Zealand business. Schroder asked for a declaration that the money belonged to him.

The defence was that the sale was not bona fide. If it were, it was a nullity, because it had not been consented to by the New Zealand At-torney-General. Voluminous evidence was taken in Sydney last year. To-day, counsel for Schroder, said he had been instrutced not to proceed. Judgment was given for defendant.
