After rebutting evidence had been tendered in the claim hv Airs A itali the jury found in favour' of the dedendant, Lubrano. (This refers to the ease in which Emily Vitali, wife of Commander Yitali, Italian Consul, sued Frank Lubrano, shipping agent, of Sydney, to recover £2OOO for alleged assault, also for allegedly publishing false statements regarding her. The action was a sequel to a divorce suit wherein Commander A'itali was corespondent, and was adjudged guilty of adultery with Lubrano. The alleged assault consisted of Lubrano slapping her on the face at an Italian dinner).
