THE FACTOR KIDNAPPING Press Association—By Telegraph—Copyright', CHICAGO, February 2. The court discharged Tuohy, as the jury failed to agree after twenty-five hours’ deliberation. A new trial has been set down for February 13. The British authorities are expected to agree again to defer the extradition of J acob Factor. [A previous cablegram stated that Jacob Factor dramatically identified Roger Tuohy and two of his henchmen as his kidnappers. He said that while his eyes were sealed with adhesive tape it was removed once to allow him to write a note to his wife asking her to pay a 70,000d0l ransom, and he then had a clear view of his captors. He said Tuohy threatened to “blow out my brains and cut off my ear to send to my wife as a souvenir ” unless the ransom was paid. The defence attempted to impair Factor’s credibility as a witness, reviewing much of his record and trying to draw the conclusion that his prosecution of the kidnapping charge against Tuohy was part of a plan to forestall extradition to England, which had already been ordered.]
