SUBSTITUTE IN TRIAL

The French and Russian prosecutors of the war criminals have reversed their previous votes and joined the United States in requesting that Alfred Krupp should be tried instead of his father, Gustav Krupp, who is too ill, says the Associated Press correspondent at Nuremberg. Mr. Justice Jackson, of the United States, recommended that the Nuremberg trials should be postponed until December 2 to enable the preparation of the indictment against the younger Krupp.
The British prosecutor opposed any delay, and moved for the trial of the elder Krupp in absentia, arguing that delay was unnecessary, because even if the son was substituted, the case against German industry was more important than that against a single individual.
An independent medical commission has reported unanimously that the elder Krupp is suffering from senile softening of the brain and would never be able to face trial.
Counsel for the Krupp family served notice that if the younger Krupp was substituted the defence would demand a full 30-day period between the serving of the indictment and the opening of the trial.

The Chamber of Lawyers passed a resolution absolving Austrian lawyers from any obligation to defend Austrian war criminals such as Arthur Seyss-Inquart and Kaltenbrunner.
U.S. ANTI-NAZI POLICY LONDON, November 14. A conference of Roman Catholic bishops and German clergy of all denominations have orotested to the United States Army authorities that the American de-Nazification policy was too harsh.
An. Army spokesman said: _ '"There are bound to be some injustices, but we have to pass the Germans through a net so fine that no fish can escape."
