CLAIM FOR INJUNCTION AND

DAMAGES

The owners of lvrusehen Salts brought uu action in tho Supreme Court today against an Auckland firm which manufactures a saline known as Rhusnl Salts. They are seeking an. injunction against tho proprietors, and they also seek £300 damages and costs. The hearing of tho action is set down for three days. Mr. Justice Ilerdman is presiding. The plaintiffs aye E. Griffiths Hughes, Ltd., and tho defendants are the Allen • Saline Company (N.Z.), Ltd.

The statement of claim alleges that tho defendants started to manufacture and sell in New Zealand a saline in the form of a white powder under the designation of Rlrasa] Salts. It was alleged that they sold it under a "getup ' ' closely resembling that of Kruschen. After objection had been taken by the New Zealand agents to the action of the defendants, certain' alterations were made to the cartons, but the name Rhusal was still used. About February, 1933, further objection was taken by the plaintiffs, and a further alteration was made by the defendants by printing a light red band round the carton. It was alleged that Rhusal cartons were similar to those of Krusehen, and it is alleged that the acts of tho defendants are calculated t mislead purchasers into tho belief that the saline of the defendants is Krusehcn. It is stated' in the claim that the defendants have threatened and intend unless restrained to/sell the salts in their, present form. All the main allegations are denied hy the defendant company.
