DAIRYING CASE DECIDED

TE AWAMUTU, 3rd March. I At the Magistrate's Court, Mr. Platts, S.M., found for the New Zealand. Dairy Company in its claim against W. Woolston for £105, liquidated damages arising out of the non-ccmplia-nce with the agreement ■ of supplies to deliver milk and take up shares in the Te Awamutu dried milk factory. Tho agreement, was signed by seventy-seven suppliers, all except eight of them supplying. The defendant Alleged misrepresentation, nondisclosure of essential facts, and that the j claim was a penalty and not liquidated damages.
