LEASE OF RACEHORSES
ALLEGED BREACH OF AGREEMENT,

NEW PLYMOUTH, 9th Decomber.. At tho Supremo Court (civil business)' Rudolph. G. Laurent (Elfcham). sued Edward M'Ginty,, of Now Plymouth, for £903 damages for breach of agreement with regard to the lease, of tho racing mares Staccato and Haversack. Tho broach of agreement was alleged in defendant roturning Haversack, which he alleged was lame and' unfit for racing. Staccato bad an accident on the Hawora, course in. May last and died. Tho plaintiff received Haversack back under protest, but refused to release M'Ginty from' tho agreement.
■ For the defence a nonsuit .was moved on the grounds that in implied condition of agreement was that both horses should remain suitable for tho purposo for which they wore leased, and,as one' was not fit tho agreement was void; also that both must continue to live for. tha term*of the lease, and as one had'not defendant was therefore freed from'flie agreement. The defence also alleged that Haversack was unfit at tlio time and prior to tho lease. ..,.,'.
Tho evidence had not concluded when tho court adjourned.
