SEQUEL TO A COLLISION

MOTOR ACCIDENT ON THE HUTTHOAD. Judgment was given by Mr. W. JR. Riddeil, S.M., to-day in the oivil action in which Alfred Southee, carter, of Upper Hutt, olaimed £50 damages from F T Clarke, of Broughamjßtreet, WeU ltngton.' The claim arose out of a colli> sion on the Hutt-road between defend- ' ant'g motor oar and plaintiff's, brake on 13th October last. _ The collision hap* pened in broad daylight, and there wore no other vohicles in the vioinity at the time. "The Hutt-road is level and wide," said his Worship, ''and under ordinary circumstances one, would not ex* pect two vehicles approaching oaoh other from opposite directions to collide. Plaintiff 'was driving a two- horse brake from Wellington to Petone, and was on the wrong side of the road. Defendant was coming from , Petone to Wellington, and iwaß on the right side. "In my opinion,',' said his. Worship, "the whole of the evidence points to the fact that both plaintiff and defendant were driving along • the Hutt-rond and not keeping a proper look-out for ap« proaching vehicles, and that, when danger was suddenly discovered neither of them was in a position - to act promptly enough to avert it. 1 In addition plaintiff was on tho wrong side of the, road:" Judgment was for defendant with costs £2 125., Mr. D. M. Findlay appeared for plaintiff and Mr. 0. Beere for defendant.
