A LOST TRAM TICKET.

AUCKLAND, 7th Amil. Proceedings were taken at the Police Court to-day by the Tramway Company against T. Wake on a charge of tiding on a tramcar from Onehunga to Auckland on 31ft December Ja*t without paying his fare. The facts of the case weis admitted by both parties. Defendant had bought a return ticket to Onehunga, and lost U. When he got on the car for the return trip to Auckland the conductor demanded a fare. This defendant refused to pay, enying he had bought r return ticket and lost it. Proceeding* were acordingiy taken. There wan no suggestion of any fraud on the part of defendant. Mr. Richmond, for the defence, rkificd a point of law as to whether the company had tho right to sue, seeing that it had not complied with clause 31 of tho Tramways Act, which Hates that a list of (he tolls or chaiges should be hung up in a conspicuous place inside the tramcnrK. The magistrate held that counsel's point did not relieve defendant from the obligation to pay his fare. There was no question of fraud involved, to a nominal penalty of 5s was inflicted, with costs £2 16s.
