"RISKY AND DANGEROUS."
A NATIVE LAND CASE. [BY TELEGRAPH.— PKESS ASSOCIATION/} DARGAVILLE, This Day. Mr. Dyer, S.M., delivered judgment in the claim by Mr. Field, solicitor, against a native, Pirika, represented by Mr. R. J. Coates, for £115 damages for breach of contract. The native last year sold certain lands to the plaintiff. The Native Land Court refused^ to confirm the sale on the grounds of inadequacy of consideration. Plaintiff appealed to the Native Appellate Court, and the appeal was dismissed. Plaintiff now claimed a return of the deposit of '£41, surveyor's charges, agent s commission and other necessary expenses in connection with sale and litigation. The native paid £41 deposit into Court, but denied liability for the balance. The court held there was no ground for the claim beyond the deposit. A buyer of native land must know that anything paid before confirmation is risky and dangerous. Plaintiff could not recover more than the amount paid into court.
