CONVICTION QUASHED

The appeal of a Chinese, Dong Wai, against a conviction and fines totalling £5O at Tauranga for being in possession of opium and an opium pipe was 'allowed by Mr. Justice Callan. The judge said it had been proved that the d ffendant informed a constable that an assistant, Ab Dong, was an opium smoker, and invited the constable to do something about it. The constable went on holiday and forgot the conversation until the appellant was arrested by other members of the Police Force. His Honour accepted the appellant’s evidence that after an interview with the constable he had dismissed Ah Dong, and that the latter left the opium and pipe behind him. The conviction was quashed.
