PENALTY ON RATES
Misapprehension Removed
Misapprehension about the payment of rates was removed in the Petone Magistrate’s Court yesterday when the Petone Borough Council brought a summons against a man who had failed to pay the 10 per cent, penalty on rates not paid within six months and 14 days of the demand.
Counsel for the Petone Borough Council, Mr. W. P. Coles, said that section 42 Of the Finance Act gave local authorities power to remit the penalty, but there was a general impression that that section gave the right of remission to the ratepayer. That was not so, and a number had been sued for the penalty, although this was the first case which had been defended.
