Man Injured at Races DAMAGES CLAIM FAILS By Telegraph.—Press Association. Hokitika, June 9. At a special sitting of the Supreme Court, to-day, Mr. Justice Blair presiding, there was heard a claim by James Edwin Searle, of Mananui, for £1029 damages and compensation for partial loss of the sight of his right eye caused by being struck by the tape from the starting barrier at the Westland races on December, 1931. After a bearing lasting all day, his Honour stated that negligence by the defendant, the Westland Racing Club, was not proved. Even if negligence had been proved there was an onus on the plaintiff who with others at the starting post was warned by the starter of the danger and told to keep clear of the starting apparatus. Judgment was given for the defendant club with costs.
