Man discharged
Francis Albert Bush, aged 53, a storeman, will not have to stand trial on a charge of receiving stolen property. After a depositions hearing in the District Court yesterday Bush was discharged on a charge of receiving, from Norman Allan Lynn, three tyres valued at $ll2, the property of Reidrubber (N.Z.), Ltd, late last year. Messrs M. B. Hayes and V. C. Empson, Justices of the Peace, upheld submissions by the defendant’s counsel (Mr D. C. Fitzgibbon) that there was no case to answer to the charge as prosecution
evidence had not shown that at the time of receiving the tyres, the defendant knew they were stolen. Sergeant R. H. Fronting prosecuted. Prosecution evidence had been given that Lynn, who pleaded guilty and was convicted in February of the theft of 30 tyres from his employer, Reidrubber (N.Z.) Ltd, told . the defendant he could get him tyres at staff rates and it would “save him a few bob.” ■ Lynn subsequently left three tyres at the defendant’s place of employment.
