Allandale appeal lost

The Mount Herbert County Council has lost an appeal to the No. 2 Town and Couni try Planning Appeal ; board against the granting of discharge * rights to Mr Gerald O’Farrell for his Allandale development. The council appealed to the board in February at the same time as Mr O’Farrell appealed against the council’s zoning at the head of the harbour which pre- ' vented him from developing a residential area in the Allandale valley, near Governor’s Bay. The board gave a favourable interim decision for Mr O’Farrell’s appeal in June and has now released its decision on the council’s appeal against the Water Resources Council which granted Mr O’Farrell the discharge right. In the two-paragraph decision dismissing the council’s appeal, the board says that the basic attack

upon the right concerned the possible presence of E. coli organisms and the inadequacy of the conditions to test for it.

The board says that testing for this organism is not envisaged in the schedules to the Water and Soil Conservation Act, ,1967. The board accordingly does not want to impose such conditions of testing as asked for, says the decision. “The board in any case, upon the facts and evidence, is not satisfied that testing for such organisms is either practical or desirable and prefers to accept the evidence produced to it in favour of the grant of the discharge right which was appealed against,” the board says. When the board gave afavourable decision for Mr O’Farrell’s appeal in June it directed that draft zone proposals be drawn up and that the appeal would then be reconvened.

This will take place on October 17 when the board will be asked to consider more detailed proposals for the development of about 170 acres of land at Allan-

dale. The board’s first decision was that the land could be developed; it now must direct the way in which it is developed.
