Man took too many mussels

A 24-year?old man who went with friends and collected 709 mussels for his “extended family” was convicted and fined $3O in the Magistrate’s Court yesterday on a charge of taking more than a limit bag.

Ben Ihaia, a spray-painter pleaded guilty before Mr B. A. Palmer, S.M. Counsel for the informant (Mr D. J. L. Saunders) said that the defendant and friends went to Ohiawa Harbour, Whakatane, on December 21.

Fisheries inspectors counted 709 mussels taken by the men. The limit bag is 50.

Counsel for the defendant (Mr M. J. French) said that the defendant had been collecting mussels for his family. These were 27 adults in the defendant’s family and the defendant’s grandfather had told the defendant stories of how many he used to collect.

There was no suggestion of commercial gain. “In fact the defendant helped the inspectors count the mussels,” said Mr French.

The Magistrate said that the limit was a conservation measure and that mussels were a natural source of food for marine life.
