Hughes action succeeds

(N.Z.P.A.-Reuter—Copyright)

NEW YORK, March 7. The American multi-mil-lionaire recluse, Mr Howard Hughes, won a temporary injunction against the manufacture and sale of such novelty items as Tshirts bearing his likeness, although the four defendant companies questioned whether Mr Hughes was even alive, and, if he was, whether he had authorised the action.

Justice Birdie Amsterdam, who ruled in the New York State Supreme Court that the defendants’ arguments were not compelling, said that the defendant companies had made an obvious and admitted attempt to capitalise on the publicity surrounding the controversy over Clifford Irving’s purported autobiography of Mr Hughes. “Whether Mr Hughes’s renowned distaste for personal court appearances will affect his ability to successfully prosecute this case will be determined at the time such appearance is required,” the judge added.
