Council Appeal Rejected
The Court of Appeal has dismissed an appeal by the Ashburton Borough Council against a Supreme Court order directing that a writ of mandamus be issued to compel the council to hear and determine according to law an application by Ogilvie Garth Clifford, a solicitor, of Christchurch, for a building permit.
Members of the Court were the president (Sir Alfred North), Mr Justice Turner, and Mr Justice McCarthy. Mr J. G. Leggat appeared for the council and Mr P. H. T. Alpers for Mr Clifford.
