COURT CASE OVER HORSE

The New Zealand-bred horse, Royal Centaur, a six-year-old gelding, is the subject of a Supreme Court case between its South Australian owner and a Melbourne trainer. The trainer, Patrick Joseph Ryan, of Ascot Vale, is claiming damages from the owner, Frank Thomas Thomson, of Semaphore, South Australia, who, he says, leased the horse to him in February. Ryan says that Thomson had the horse removed from his stables to those of F. Lucas in Flemington. Mr J. Monah, for Ryan, told Mr Justice Lush that the horse was “frozen” at Lucas’s stables as a result of an interim injunction granted by Mr Justice Barber in chambers last week. He wished to apply for an interlocutory injunction pending the action, but as the other side could not proceed, he would consent to an adjournment until April 18. “The matter is of some urgency,” Mr Monahan said. “The horse is now fit and, if your Honour is interested, pretty close to being ready to win.” Mr Justice Lush: You’d better find a judge who knows more about these things.
