TRAFFIC CHARGES ADJOURNED

Withdrawal Not Permitted

The transfer of a traffic officer to another centre some distance away is not sufficient ground for the withdrawal of traffic charges, Mr Raymond Ferner S.M., ruled in the Magistrate’s Court yesterday. Five charges against two men were adjourned to February 18. Senior Traffic Officer W. J. Tait appeared for the Transport Department. He said that Traffic Officer Hume, who laid the informations, had been transferred to New Plymouth. The Magistrate said that he did not think that the traffic officer’s transfer was sufficient ground for the withdrawal of the charges. “Have you any other reasons?’’ he asked. “Those are my instructions, sir,” said Traffic Officer Tait. “However, if we have to bring him back. . . .”

“The equal administration of justice demands that the charges should proceed, except where the consequences are wholly disproportionate,” the Magistrate said. “I think you should proceed.”
