MAGISTRATE’S COURT

MONDAY (Before Mr Raymond Ferner, S.M.) REMANDED Joseph Charles Marks, a labourer, aged 40, was charged with obtaining 7s 6d in money from the Army Department by falsely representing that he was one Norman Andrew Victor McLeod, who was entitled to draw the money for attending before the Army Medical Board. Detective-Sergeant F. J. Brady, in asking for a remand to May 9, said that accused would be charged jointly with another man. • The remand was granted. Bail was renewed at £lOO, with one surety of £lOO. A young man whose name was ordered to be suppressed in the meantime was charged with indecent assault on l a female. He was remanded to May -13. bail being allowed at £2OO ift his own recognisance, with one surety of £2OO. He was ordered to report daily to the police. FINE FOR ASSAULT Edwin Ernest Balloch, a motor driver, aged 25, was charged with assaulting George Desmond Balloch. Sub-Inspector G. J. Paine said that accused had been found assaulting his brother on the lawn of the latter’s home in Riccarton. There had been a wedding in the family that day, and a party had been held in the evening, at which liquor had been consumed. An argument had ensued, and the assault had taken place. The police had then been called. Accused’s brother' had been in hospital for an X-ray examination, but it had been found that there was no serious trouble.

Mr W. R. Lascelles, for accused, who pleaded guilty, said that the argument had developed after accused had stated his intention of driving his car home. His brother had tried to dissuade him, and the assault had taken place. Accused had been an amateiir wrestler, and if he had let himself go he could have done more harm to his brother. He had, however, chosen ’ to take punishment and try to pacify his brother.

A fine of £5 was imposed. PLEA OF GUILTY ENTERED Wallace Desmond Sharplin. a soldier, pleaded guilty to assaulting June May Topp. Sub-Inspector G. J. Paine said that accused and a companion, when under the influence of liquor, visited complainant’s house in Ferry road. They had been ordered off the premises, but would not go. The daughter of complainant slapped accused’s face and ordered him out of the room. Accused had then punched complainant on the face and had assaulted the girl, not severely, however. He and his companion left the house, and the police had been called. The two men were found down the street, and had been identified as the men who had visited the house.

Accused said that he had asked a man if he knew where there was a party on, and he had been referred to complainant’s house. His face had been slapped, a bucket of w'ater had been thrown, and he had been hit with a broom handle. He had merely been defending himself. PROBATION EXTENDED Mary Adelaide Wilton, a domestic, aged 32, appeared for sentence on three charges of theft. Detective-Sergeant F. J. Brady said that the cases had previously been adjourned sine die, on the condition that accused became a voluntary patient at the Sunnyside Mental Hospital. She had been discharged that day. The Magistrate said that in accused’s own interests he would extend her probation for a further two years from that day on one charge, and convict and discharge her on the other two.
