JUDGMENT FOR DEFENDANT MINER’S CLAIM AGAINST HOSPITAL BOARD (P.A.) AUCKLAND, April 20. After a hearing lasting for a full week, an action In which a liuntly miner, Andrew Marelich, aged 56 (Mr F. 11. R. Halgh and Mr A. K. Turner) claimed £5050 damages from the Auckland Hospital Board (Mr V. R. Meredith and Mr L 'JrXJoldsitipe) came to a close this even|ng. The .plaintiff, who had his right leg amputated above the knee at the Auckland Hospital on May 13, 1943, alleged that this operation had become necessary because of negligent and unskilful treatment by the staff after an operation for a torn cartillage of the knee. He alleged that gangrene had been brought on hy too tight, bandaging or by a .tourniquet. The Hospital Board, denying negligepce, submitted that the trouble was caused by a rare condition of the. artery known as vavaspasn, for which no one was to blame.. . . ■ ■ The case was tried by Mr Justice Gallan and a -speetarjury.
