A TRUST ACCOUNT.
ALLEGED FALSE DECLARATION.
(MESS ASSOCIATION WSLEGRAIf.) NEW PLYMOUTH, July 29.,
Arising out of the prosecution of H. J. M. Thomson, solicitor, of Inglewood, who was recently sentenced for the theft of £BOOO trust money, LaWrence M. M. Monteath, accountant, New Plymouth, was to-day charged with making a false declaration in relation to a solicitor's trust account and was committed to the Supreme Conrt for trial. Bail was allowed.
Evidence was given that Monteath had made the usual declaration that he had personally audited Thomson's trust account in which it was subsequently proved there were large deficiencies. The police allegation was that . Monteath had not made a personal audit. Monteath's solicitor, m asking for the dismissal of the charge, explained that Monteath had relied on the examination of the books by T. C. H. Nicholls, a registered accountant, and had made the declaration before a J.P. Counsel quoted authorities to show that "personal examination" had a wider meaning.
The Magistrate decided there was a case to answer.
